1. Legal Notice.

In compliance with the Law 34/2002 on Information Society Services and Electronic Commerce (LSSICE), we inform you that evenia.travel (hereinafter, the “Website”) is a domain name owned by EVENIA TRAVEL S.L (hereinafter, “EVENIA TRAVEL”), with its registered address at Calle Muntaner 401 entlo. 1ª 08021 Barcelona – Spain, Tax ID B-08712358, and registered in the Barcelona Commercial Registry, Volume 4681, Book 4004, Section General, Sheet/Dup 50545, Entry 1st.

2. Objective

This document aims to regulate the rules of use of the Website (hereinafter, “General Conditions”) and safeguard the protection of its users. The terms “You” and “User” are used here to refer to all individuals and/or entities that access this website for any reason.

EVENIA TRAVEL provides information and services related to our hotels through the Website (and its other official web pages), such as online room reservations, image galleries, customer support, and various evolving promotions (hereinafter, the “Services”).

3. Navigation and Acceptance of the General Conditions

The use of the Website and/or its services grants you the status of a user, and implies full and unconditional acceptance and validity of each and every one of the General Conditions set out in the latest updated version of these rules of use. Therefore, the user must be aware of the importance of reading them every time they visit the Website.

4. User Registration

Registration. User registration is completely free and is a necessary condition to contract services through the Website (in the “MY ACCOUNT” section). During the registration process, certain user data will be requested to process the various services.

Username and Password. If the user decides to register on the Website, a username and password will be requested, as described in the Privacy and Data Protection Policy.

Age. The user declares that they are of legal age (over 18 years old) and have the necessary legal capacity to contract the services. They also state that they accept the binding nature of these General Conditions of Use, which they declare to understand and accept in their entirety.

Minors. In the event that the user is a minor, they will require the authorization of their parents or legal guardians to contract services through the Website, by providing the relevant documents (including but not limited to, an email attaching a duly signed authorization letter, providing a photocopy of the ID card or passport, or sending it by fax), which EVENIA TRAVEL would request for these purposes prior to contracting the services.

4. Protection of Personal Data

In accordance with Article 5 of Organic Law 15/1999 on Data Protection and its implementing regulations, the user expressly consents to the data provided during the provision of the service, whether during the reservation process or through the contact form to request information, being collected and processed in an automated file owned by EVENIA TRAVEL S.L., with its registered address at Calle Muntaner 401 entlo. 1ª 08021 Barcelona, Spain.

The purpose of this processing is to provide optimal customer service and, in the case of contracting our services, to comply with billing and payment requirements, company accounting and auditing, statistical analysis, as well as conducting satisfaction surveys and commercial communications by email, mobile channel, or telemarketing regarding EVENIA TRAVEL’s products and services, related to services offered through EVENIA TRAVEL’s website, which it considers may be of interest to the user due to their similarity to those contracted. In the event that the user does not wish to receive commercial communications by email, they may contact EVENIA TRAVEL at any time in writing to the Marketing department at the above-mentioned postal address or by email to info@evenia.travel, identifying themselves appropriately (and including the reference “Ref. Data Protection”). Likewise, the user may also exercise their rights of access, rectification, cancellation, and opposition by written communication, attaching a photocopy of their ID card or equivalent identification document, addressed in writing to the Marketing department at the above-mentioned postal address or by email to info@evenia.travel, identifying themselves appropriately (and including the reference “Ref. Data Protection”).

Likewise, the user expressly consents to the data provided and those that may be collected during the provision of the service being transferred to companies of the EVENIA Group (as described below), for the effective provision of the contracted service (billing and reservation management) and for sending commercial communications about (i) EVENIA TRAVEL’s products and services and those of EVENIA Group companies (located in Spain, European Union countries, and abroad) in similar sectors to those contracted; as well as (ii) products and services of third parties (located in Spain, European Union countries, and abroad) in similar sectors to those contracted.

EVENIA TRAVEL guarantees the adoption of appropriate measures to ensure the confidential treatment of such data and will take the necessary measures to prevent their alteration, loss, processing, or unauthorized access, taking into account at all times the state of technology as provided for in current Spanish legislation on the protection of personal data.

5. Cookies

Some of EVENIA TRAVEL’s personalization services use cookies.

A cookie is a very small text file that a web server can store on a computer’s hard drive to store some type of information about the user. It can only be read by the website that sent it to the computer.

Websites typically use cookies to obtain statistical information about their web pages and analyze their customers’ behavior.

EVENIA TRAVEL uses cookies solely for the purpose of compiling usage statistics for its website. The information that EVENIA TRAVEL stores on your computer through this mechanism consists only of a number that identifies a user, as well as preferences such as the preferred browsing language and the date on which the cookie was deposited. This will allow the website to recognize you on your next visits. It does not contain any personal, economic, or health data.

EVENIA TRAVEL may also record your IP addresses to diagnose any problems with our server, manage our website, and analyze user trends.

6.- Confidentiality

EVENIA TRAVEL will not disclose your personal data to any third party except as provided in the preceding sections.

EVENIA TRAVEL guarantees that it will treat your personal data confidentially, and that the server on which the data will be stored and processed has the security measures established by Spanish data protection legislation.

7.- Use of the Website and Service Contracts

7.1. Use of the Website: The user agrees to use the Website and the services made available through it in accordance with the law, morality, good customs, and public order, as well as with the provisions of these General Conditions. Consequently, the user is obliged not to use the Website or its services for illegal purposes or effects and/or contrary to what is established in these General Conditions, harmful to the rights and/or interests of third parties, or that, in any way, may damage the Website or hinder its normal use or the services accessible through it. In this sense, in the event that the user does not respect these General Conditions, EVENIA TRAVEL reserves the right to immediately suspend the user’s account (if they have one) and may also deny them access to the service.

7.2. Service Contracting Procedure: Users will access the Website either directly through the Website or may optionally subscribe to EVENIA TRAVEL’s newsletter service to receive commercial communications, and they may also register individually and create a personal account on the Website, where the list of contracted services and the user’s personal data and other functionalities will be stored in the “MY ACCOUNT” section.

After selecting a specific service published on the Website, users can formalize the reservation process for that service. The user will receive a confirmation email indicating the status of their purchase order (confirmation, request for modification, or cancellation of the service). This email will serve as a voucher for their reservation/service.

A reservation is considered contracted when the user clicks on the reservation acceptance document. The confirmation of the reservation is made at the time EVENIA HOELS sends an acknowledgment of receipt and confirmation of the reservation to the user’s email, which will take place within twenty-four (24) hours following the receipt of the service reservation formalization by the user. If the user does not receive any email within this period, they must immediately contact EVENIA TRAVEL so that we can resolve the situation as soon as possible.

7.3. Guarantee: The reservation is confirmed and guaranteed for a period of 24 hours with a credit card. In case of a no-show at the hotel without prior notice, the first night’s stay (including VAT and taxes) will be charged, or, in the absence of this, the amount agreed upon in the specific rate conditions.

7.4. Contract Termination or Reservation Cancellation: The credit card is only a guarantee. The user’s cancellation of reservations will not incur early cancellation fees, as long as it is done before the time established in the conditions of each rate. Beyond that threshold, EVENIA TRAVEL will charge cancellation fees, which will amount to the sum established in the conditions of each rate type. In the event of early departure on dates other than those contracted, EVENIA TRAVEL will not provide refunds.

7.5. Room Prices per Night.

Prices are only valid in writing and for the period specified in each offer. When there are justifiable reasons, EVENIA TRAVEL reserves the right to modify these rates without prior notice. The prices for the reservation will be indicated during the reservation process. Prices are subject to VAT, and additional taxes may also apply in accordance with the local regulations in force in each of the countries or autonomous regions. These local taxes must be paid directly at the hotel. The user will receive a confirmation email with the details of the contracted offer and the corresponding price (plus VAT), which will be visible in their user account.

The services do not include transportation to the reserved hotel, which is the responsibility of the user, to the location where the service will take place unless a specific offer (flight and travel package) provides otherwise, in which case the conditions established for that offer will apply.

Please note that, regardless of the currency selected on our website, all transactions on www.evenia.travel are conducted in euros, and the exchange rate shown in other currencies is for informational purposes only and has no contractual value. Claims for exchange rate differences will not be accepted.

7.6. Payment: Once the user has decided to contract a service offered on the Website, they will be asked for a series of data for the effective reservation and contracting, and, depending on the contracted offer, the user may choose from these payment options:

1. a) direct payment through EVENIA TRAVEL, in which case instructions for making the payment through the Website’s payment gateway will be provided, and the Special Conditions that apply to that specific service will also apply. Payment can be made by credit card or bank transfer, as indicated for each offer.

7.7. Errors. EVENIA TRAVEL is not responsible for errors in the reservation when the data provided by the user is incorrect, incomplete, or false, and any problem or expense associated with this problem or its resolution will be the sole responsibility of the user.

7.8. Cancellation and Modification/Extension of Service Reservations. Users may cancel or extend service reservations accepted and confirmed by EVENIA TRAVEL as long as the offer allows it and in compliance with applicable regulations. This information will be provided to the user in the offer itself and, if applicable, in its Special Conditions.

EVENIA TRAVEL provides the user with a procedure established in the “MY ACCOUNT” section of the Website, in the “MY RESERVATIONS” section, which will specify the refund and/or cancellation

fees associated with the cancellation. The cost of extending/modifying a Service reservation will be specified for each individual case.

In the event that the user has made an advance payment for the services contracted through the Website, they will be entitled to a full refund of the amount paid (minus the management fees identified at the time of service contracting) as long as the cancellation is made within the cases provided above. EVENIA TRAVEL will refund this amount to the user by bank transfer within 30 days.

EVENIA TRAVEL will not be responsible for the expenses incurred by those cancellations that do not follow the steps established in this procedure.

8.- Intellectual Property and Copyright

All the information contained on the Website, its graphic design, and the source code are protected by copyright or other intellectual property rights. Without prejudice to what is established in these usage rules, the distribution, modification, assignment, public communication, reproduction, or any other act with respect to all or part of the information published on said page without prior authorization in writing from EVENIA TRAVEL is not allowed. Any reproduction or copy, distribution, or publication, of any kind without the prior and written authorization of EVENIA TRAVEL is prohibited. Authorization for reproduction can be requested by emailing info@evenia.travel.

9.- Right to Modify the General Conditions and Exclusion of Guarantees and Liability.

9.1. Modification: EVENIA TRAVEL reserves the right to modify these General Conditions, informing users of the modifications made through the Website. For this reason, the user must regularly check the latest version published on the Website, which will be accepted each time they connect to it. These modifications will only apply from their effective date. In any case, before contracting any service offered on the Website, the acceptance of both the General Conditions in force at all times and, if applicable, the corresponding Special Conditions for the contracted service will be required. It is stated that in case of conflict or contradiction between the General Conditions of Use and the Special Conditions, the latter will prevail.

9.2. Guarantees and Liability: EVENIA TRAVEL does not guarantee the reliability, availability, or continuity of the services made available to the user, and therefore, excludes any responsibility for damages and/or losses that may arise due to the lack of availability or continuity of its website or its services, even if it attempts to provide, to the extent of its capabilities, technical assistance to the affected person and to immediately restore the interruption, making alternative means available.

EVENIA TRAVEL is exempt from any responsibility that could arise regarding the content of the opinions or comments published on its website, made by its users.

10. Links/Hyperlinks

In the event that the Website refers through links to advertising or third-party websites, EVENIA TRAVEL is not obliged to control and does not control, approve, or make its own the services, content, data, files, products, and any kind of material existing on the third-party’s website or websites, so EVENIA TRAVEL will not be responsible, under any circumstances, for the legality of the content of these pages, and the third party will be solely responsible for complying with the law, morals, good customs, and public order with respect to the content, as well as ensuring that it does not infringe the rights of third parties in any way. The existence of a hyperlink does not imply any relationship of any kind between EVENIA TRAVEL and the owner of the website where it is established.

Those users or third parties who intend to establish a hyperlink to the Website must obtain prior and written authorization from EVENIA TRAVEL and guarantee that the hyperlink only allows access to the pages or services of the aforementioned Website but does not make, in an illustrative but not limited way, reproduction of content, deep links, browsers, inaccurate or incorrect statements about the content or the Website. Except for those signs that are part of the hyperlink, the user will ensure that the website on which the hyperlink is established does not contain trademarks, trade names, establishment signs, names, logos, slogans, or any type of distinctive sign belonging to EVENIA TRAVEL.

11. Survival

If any clause included in these general conditions is declared, in whole or in part, null or ineffective, such nullity or ineffectiveness will only affect that provision or the part thereof that is null or ineffective, and these general conditions will remain in effect in all other respects, with this provision or the affected part thereof being deemed not to be included.

12. Applicable Law and Jurisdiction

These General Conditions, as well as the Privacy Policy and Cookie Policy, are governed by Spanish law. EVENIA TRAVEL and users, for the resolution of any dispute that may arise regarding their validity, execution, compliance, or resolution, in whole or in part, submit, with express waiver of their own jurisdiction or any other that may correspond to them, to the jurisdiction of the Courts and Tribunals of Barcelona, unless the law establishes otherwise. This contract constitutes the complete and integral expression of the agreement between EVENIA TRAVEL and the user, and it replaces all previous agreements, commitments, statements, or agreements, both written and oral, that may have existed between them previously.
